I would like to think that by now DOS combined with CIS probably have a good estimate of the spillovers based on historical trends, current demand, pre-adjudicated cases, existing I-140's and porting cases. Assuming they have this data and the current availability of visas including spillover for 2011 as someone pointed out they might take the dates out towards 2008-2009 possibly since the CP cases are also coming to a close. Hence they could open a 2 year window so that the pipeline can move consistently instead of opening the pipeline by making EB2 India / China Current and flooding the system causing endless delays.
I think most of us ignore the CP cases which DOS/ CIS has to ensure has a full workload possibly explaining the NVC updates of fee requests-
I would bet that whatever they do they will work together with CIS is to ensure that workload with CIS and consulates all around the world is maintained and if anything a smooth consistent pipeline is also established for the future- this is just a guess- most of it is anyways.
We will see....

How is your experience with Lingo customer service. Last year, I tried to switch to Lingo and the lady at customer service is very rude. She is so tired to answer questions and asked me to get all from website. I stopped switching to them.
This is true. Lingo customer service is bad. Now I am stuck with them for 2 years. Rep was rude. Talked to the supervisor. Even he was rude. Asked him to pass me on to his manager. He refused to directly transfer to his manager.
I am even thinking of paying $100 cancellation fee and get off their service.
I am happy that Vonage came up with a good plan.

Flying through Asian Countires is not an option for people residing in East Coast. I am travelling to India in the next week Via Amsterdam. I am told by the consulate that we do not need Transit Visas. My H1B Visa is expired and I am travelling on AP. Did any one hear differently?

It's funny how many types of personalities you see in everyday life. I remember in my early childhood days there always use to be one guy at the least in my class who would do things that would freak everybody out....usually he would be the teacher's cutest student. I have been a reader on this site for years and have contributed to many of the fund raising campaigns. I agree with many of the comments on this thread. Brothers and sisters we need to team up and clamour for fair treatment; let us all contribute with dollars and sweat. I assume most of us on this site can afford to contribute a lot more than we have in the past and the potential rewards (fair opportunity to Immigration) are immense.
I have personally been in the US for ten years and believe I have contributed to the society a lot - while being a law abiding tax payer (I wish I could use the word citizen). And my story is not any different from any of yours. Why then we haven't gotten what we deserve at this point, afterall we have earned it by our sweat. The reason is we haven't realized our strength: in numbers, in dollars and in our contribution to the American society. No one is going to listen until we make our plight known to the public at large and to the law makers.
Some thoughts on how to go about doing it. We need a detailed plan with names of volunteers who can contribute their time. The plan should also include a list of key law-makers we are going to contact and how. All of this will cost money - so the first thing to do is support the fund-raising efforts. I also think we need to increase the fund-raising target by a lot; because the stakes are so high.
I apologize if I have wasted anyone's time with a long post. And I thank all of you for caring for one another and by sharing so much info with all the silent readers of this site. I have learned more about immigration from this site than my employer or immigration attroneys could ever share with me.
I will now put my money where my mouth is by making a contribution to Immigration Voice.

Unless that comes from the core group, I'd atleast not just day dream, blog but will also Do somehting by writing to whatever sources I know. Keep writing , we all have very good writing skills.. keep doing it while we wait on other things...Do it non-stop.. atleast twice a week. spread it to friends..

My wife got the approval on Oct 5th...CPO mail was first followed by approval notice and I also got a CPO mail after 35 days of approval....strange and surreal it seems

I may be wrong since my wife's case was separated.....But this was from my congressman's office who told me that the reason that her case is pending and delayed is because our case got separated during adjudication.

(Even nitty gritty details like which day and time the Immigration Officers generally will be in a good mood to hear us - Yes its true that our situation without GC is that pathetic). It might be so helpful for others who are still waiting to deal effectively with these officers. During my conversation with one IO, she told me the IO's ID who is reviewing my kid's file and asked me to send a detailed mail to that IO.

Hello,
I have to travel to India this month and still in a dilemma whether to take a Visa appointment or to travel on AP, I don't see many experiences from Delhi consulate so having difficulty in deciding.

I saw that Ron told one "so depressed" in his Forum..that we can launch a law suit..against this new interpretation..however..I dont know its worth the time and effort..although uscis learns only by law suits..
Lets see next months Visa allocation for the new year and see where it starts from..I am hoping from Mid of 03..lets see..besides..only quick solution so far is the Visa capture ..dont know where it stands...
we got 20 more days to influence people about EB-3 numbers..what is the most effective thing to do collectively before he new Visa bull comes out..

Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????
My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

It is not too late to write the letter, it is never too late to write the letter!!
Since the letters are only requesting fixing of the interpretation of the law, and not the law itself, there really is no fixed deadlines involved. Of course, sooner it is done, the better our chances are for moving forward.

We had our interview on January 17th in chennai Consulate. Interview was smooth - which company.. how long you were working for the company and what do you do there.. these were the questions. We were told at the end that we will receive passports within a week.
So far We ( H1B extension -- 3rd time and my wife - H4( 2nd Time), have not received the passports. I already postponed our date of travel to Feb 5th. Looks like I have to postpone again.
Frustated..
Calling VFS daily to hear the same news.. Passports not been handed over VFS. The VISA is still under process.
Called Consulate Twice ... they say they are doing security checks..
for how long???
