I found this forum after my I 485 denied as I applied for AOS under AC21 at texas center on 12/31/2008. The first thing I did after joining IV is sent the four letters.

I was also told that it may take anywhere from few days to 7-8 weeks. Today is February the 8th, 2008, and am still waiting on my visa. So if its any consolation to you stuck_here, I'm stuck here for almost 65 days now. Given that I have a PhD in Chemical Engineering, I might have fallen under the Technology Alert List, but, still, the wait time seems ridiculous. Any ideas from anyone about if there is anything I can do on my part to expedite the matters? Thanks.

Not an issue. It can be done using business necessity letter. Companies like Google should not have a issue as they regulary higher such qualified people. On the other hand , the non genuine case will have difficulty as from now onwards these positions will be scrutnized more closely. Moreover, any indication of fraud may result in the the audit of original labor also.
Not only consulting companies but genuine companies in the software arena will also face trouble. If I interpret it correctly, most new hires at places like Google, MSFT, Amazon etc. even if having MS from top-notch universities in the US can apply only under EB-3 as their job description will fall in Job Zone 4.
On the other hand somebody having a non-IT or CS degree from a mom&pop University can find a job, state its "research" and upgrade to Job Zone 5 and apply under EB-2.
I wonder how this will fly with the affected companies?

Guys, Are we sure that Fedex will not deliver on saturday or sunday, what will happen if they deliver, nobody will be at USCIS to accept right, so it will still be opened only on monday ?
IUnless id you selected Saturday delivery as special service Fedex wont deliver it on saturday . USICS is sure closed on saturday unless the mail room guy wants some overtime( assume he was a contractor as USICS is employing more contractor these days for the sorting work) and comes on saturday

But are n't they proposing 50 % rule.. how can a small desi company afford 50 % US citizen staff ? That is why may be people think consulting companies will not work.
but what I think is it will make them less profitable. Very small body shoppers will go out of business. Med to large indian owner based consulting companies will be less profitable.

A lot of the companies, I believe will have 50% with GC holders/citizens/T1/OPT/Add any other visa category who can work.. Since the bill restricts only H1B/L1.
There are some assumptions, I guess on above post, that americans are paid more etc... which is totally wrong... A lot of the folks in this community, I believe, based on my own experience are paid more or at par with american counterparts. (I guess, about the profitability, if you mean it in terms of less productivity, I agree with that.)
I guess the genuine companies will move the H1/L1 staff abroad along with positions to meet this requirements if at all this becomes law. What that means is more job loss in US. (Whether US has 50% of total "high skilled" work force necessary to run the operations of all the companies is another important question... I do not think so, may be the senators are considering highschool dropouts to handle the "high skilled" jobs :), I read somewhere about a recent survey and only 27% of 25-45 age group of population has a college degree in all discipline. I will try to find the link)
Over all, I see this move by senators as short sited and will prove disastrus to America in long run given the fact that no other country in the world is as dependent on technology / research and development as US.

The porting to begin with was unethical in our mind and we took a stand. We were challanged by several people on this forum but they did not realize the extent of our convictions.
Unlike others with their lawsuits Ideas, in this case we did follow up on this issue by contacting DOL in early September with our greivance along with a famous lawyer on our side. Enclosed is our letter to Secretary of Labor Elaine L. Chao and other senior officials. We would like to think that our effort has contributed to the recent change in the Job Zones for Computer Information Manager, as that was specifically mentioned in our letter.. This was not exactly our intention as we just wanted DOL to put some more control around the process. Hence our apologies for the unintended consequences of this effort on the future applicants.
Thanks to these members who actively/morally supported us.

It is not true. The orignal text in IMMIGRATION AND NATIONALITY ACT says "Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraph (1), to qualified immigrants who are members of the professions holding advanced degrees or their equivalent or who because of their exceptional ability in the sciences, arts, or business, will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States, an d whose services in the sciences, arts, professions, or business are sought by an employer in the United States.
Beyond 28.6 percent, there is no words/requirements from the law that EB1 should spillover to EB2 first, then EB2 can spillover to EB3. It is just saying that EB1 can spillover to EB2, EB1&EB2 can spillover to EB3.

Recently I travelled by Jet Airways and I had very good experience. They provide world class service even for Domestic flights and their international flights are just awesome. Brand new aircraft with bigger tv screen and they fly ontime. Also, no transit visa required at Brussels so no hassle for TV.
The only drawback of this is that you are not allowed to carry any liquid (including liquor) from US. However, you can buy as much as you want at Brussels airport and the prices are same as in US.

I had already mentioned my EAD status when they had the interview. But after acceptiing it I mentioned it again in the conext of I9 form. Then they said they cant offer me emp;oyment due to my being on EAD.
This is a pretty big company. I understand that H1B is not protected under anti-discrimination for employment, but EAD holders, specifically those with AOS pending, are a protected against employment discrimination.
Does anyone have any links to the above conclusion ? I am so tired of this BS. I have spent long enough in this immigration c**p that if I have leave, might as well leave with a fight.
