    hi attorneys,

    which visa should an indian citizen apply for if he is seeking to start his own business in the USA?

    i understand that the e-visa is not applicable to indians. is there an equivalent of the e-visa for indians seeking to do entrepreneurship in USA?

    Hello All,
    I got my US green card in EB3-I category through consular processing after an interview in Montreal, Canada in 2004.
    My PD is 29 March 2002. My family could not accompany me to the interview and hence they did not get their green cards at that time. I wanted to schedule an interview for them since 2008 and the Montreal Consulate informed me that my PD is not current. This is somewhat strange as I have already got my Green card in 2004. I have tried all options but everyone tells me that I have to wait till my PD becomes current. I am not a US citizen yet. The way EB3-I is going it will be easily another year till my PD becomes current. (The PD date has moved by 1 month in the last 6 months)

    I will appreciate if anyone has any suggestions for me.

    As long as the employer/employee relationship exists, an H-1B alien is still in status. An H-1B alien may work in full or part-time employment and remain in status. An H-1B alien may also be on vacation, sick/maternity/paternity leave, on strike, or otherwise inactive without affecting his or her status.

    I am currently using my EAD and working for a company remotely from my house. I also have a Permanent Resident Status in Canada. I can work remotely from Canada and my company will not have any objections to it.

    Since I am on 485/EAD can I work for a US company and be on their pay roll and live in Canada? What are the ramifications?

    Please advise!

    There is no FIFO system.. whatever gets picked out of the DUMP gets processed.. I don't think one can draw any conlcusion based on approvals..

    My 140 was denied based on the filing was Eb2 but job requirement only fits in eb3.

    I filed my appeal with a new 140 on the same labor in Eb3, and in my Motion to Reopen specified to consider my old application in eb3 but if they will not to atleast consider my new application. This was an year back and I have filed premium, my new 140 was approved in 3 days, old one went AAO, but we withdrew the old one.

    Talk to a good attorney, I consulted Aron Finkelstein in Murthy law firm. They were nominal and excellent customer support.

    Thanks in advance for answering my question:

    I have had an EAD from past 2 years, but I also had a valid H1B I was working for company A on H1 and my GC is filed by Company B future employment(and hence the EAD)

    - Company A went down last year, so I was laid off, so my H1 lapsed.
    - I switched to Company B since I have an EAD through them.
    - I am on Company B's payroll currently.
    - The company A folks needed help after they were shutdown, I helped and was paid for hours. (doing same and similar work) but not issued a 1099...

    Question - I will need to file taxes on those hours, in terms of immigration have I done anything out of ordinary here? I don't know if USCIS and IRS connecected, or I am just being paranoid here?

    I have been facing the same issue for past couple of days. What is the use of providing a facility to check online status when they are not capable of handling enough traffic to their website.

    Yes. I have been getting this message when I login from work as well as home computer. I generally check my EAD application status once every 2-3 days and yet USCIS thinks that is an "excessive" use. I am pretty sure they have some issue with the website.

    It was reported to us that your computer or internet gateway has been locked out for a select period of time. This is due to an unusually high rate of use. If you feel this has occurred incorrectly, please contact the Customer Service Center for assistance at 1.800.375.5283.

    Can you at least produce the extension receipt at the embassy? Is your job title IT Consultant? If the answers are no and yes, personally I would not risk it. Of course this is nothing more than a personal opinion. My H-1B expires in April. I waited for the past 3 months and got my extension approved so I'm going back to China this month.

    My Labor is stuck in Atlanta processing center.... It is frustrating to see people getting approvals in 2 days from Chicago center.

    While people who apply to Chicago today, can file 485 by July, I'm gonna miss the boat :eek:

    Of course I don't compare myself with people stuck in BECs

    Can I work for a couple of days using tax form 1099 while on H1B? The amount for the number of hours while working will be less than $600. Please help.
