I know for a fact that you cannot count current employer exp for GC.
You can use experience with the same employer, but not in the same position as you note next.
If i start working for the same employer on 15-1031.00 Computer Software Engineers, Applications , is it more than 50% different in role so i can count my 3 years experience when applying my GC ??
Nobody could tell just by looking at the DOT job descriptions. Your actual job and duties are what is important, not any DOL codes or descriptions. if your duties in the 2 jobs are 50% different, you should be able to use the experience.

I agree with all the above.
Also, since you wokred on EAD, you are no longer in H1B status. You will be OK - but it is better to ask the H1B petitioner to withdraw the H1B application to avoid any future complications.

Hello,
As H1-B visa is tied to an employer, you should get the new H1-B stamp with your new employer as the sponsor.
At PoE, the IO may ask you to show the current employment letter, especially as you are coming to US after a long absence.

My feeling was that there are No NEW jobs here in USA especially for immigrants. I felt jobs are slowly being offshored and new job creation was not catching upto that. This matches with unemployment numbers 10%+... Also I feel there are enough people looking for PROJECT while on H1B..
Its good to see this is changing with new H1b hiring happening!!

I hope so but I don't tink H4 can get financial aid. If perhaps you can get your child as a parolee, there is a possibility...but there are technicalities there as well

We have immigration matters that needs to be updated but we don't know what we should do?
The following are affected
1. EAD
2. H1B
3. AP
4. I 485 related things.
My Ead and Ap has old address and the card also holds the same old address.
Could you please tell me what steps I must initiate to get this straightened out? Do I need a new EAD card? Please help me.

If I want to do premium processing of my H1 visa, how long does it take for an approval or denial ?
Actually I had an H1 visa 2 years back and when I had my baby I quit my job and my H1 was cancelled by my company. Now I am on H4 and want to work again. But no company is doing H1 these days without a job offer in your hands and even if I get a job offer no client company is willing to wait for a long time for my H1 approval. So, I wanted to check my options with premium processing. How long does it take if I go for premium processing of H1 visa ?

I have a pretty simple question.
A person decides to change employers, moving from company A to company B. It's been 180 days after 485 filing.
Question: what does company B have to do to legally take this person on as full time employee? Is the process any different than taking any other american resident employee? The way I understand is it is not any different.

Nothing. The employee must have EAD. That's all. Also, the employee should, but does not have to, ask for a letter with duties to be sent to USCIS to keep USCIS informed of the change.

Got a 221g (pink) from Chennai consulate because I have a Phd in biology. After almost 4 weeks the status on the website was updated to 'submit passport'. I have a couple of questions. If anyone who has gone through a similar situation, can answer, I would very much appreciate it..
1. I have been asked to submit the passport to VFS. How long did it take for passport to be returned with visa.
2. I have already gone through the security clearance. Do I need to go through PIMS clearance again?
Please...appreciate responses from those who have gone through this themselves..

Security clearance is different from PIMS from what I understand... two different processes...with some luck you might already be cleared for PIMS...I guess you will have to submit your passport and see. Cheers...

Received the RFE today. It was asking for my birth certificate copy & translation. My lawyer says this is very common. For me this is stupid, they already got my birth certificate copy and the translation.
