StuckHere: As a backstop, do you have AP in hand? If yes, my attorney has recommended sending a letter withdrawing your H1-B stamping application to the consulate where you interviewed. Then with a copy of the letter in hand, and with your AP, seek to reenter the US on your own terms... Good luck...

I have just filed for PERM in nov '07.. and I don't have an AP handy either. Can I get my company to apply for one ?

    THanks !

I received my GC by snail mail. Here are the chronological events--
08/02 (Monday)- PD became current, called to open SR:confused:
    08/03 (Tuesday)-CPO e-mail:)
08/10 (Tuesday)- Welcome notice received by snail mail
08/13 (Friday)- GC received by snail mail :D

The card looks like a credit card, greenish in color (hey, after all it is GC). It does not smell or taste good :D I looked at the card for almost an hour before going to bed. :D

As a 'masterji' one advice to all: If possible, try to complete a graduate degree (M.S., MBA, Ph.D.) from US. Besides self satisfaction, it REALLY helps professionally.

    Good luck to all!

Thanks for your reply. Yes you are right but though I had the choice I was not allowed to enter on H1. Now when my AP is expiring on 01/26/2007 would it mean I may go out of status even if I have a valid h1 till 06/01/2007?

No, you will not be out of status. It only means you won't be able to travel out and re-enter after 01/26/2007 without obtaining another AP.

Thanks Ramba for the analysis. Kudos to you to bring out the true fact regarding the spill over. I see you are belong to Eb3 ROW category but still you stood for the truth.

Lot of analysis. Here is my part. If DOS properly followed the INA as amended by AC21 act in 2000, EB2-I never retrogressed since year 2005. EB2 I might have been always current. EB3 including ROW might have been much worst situation than now. EB3-IN will always be in disaster state. Though it is unfair to (EB3) many, this is what the law. In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. Thats why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair) the law. If they follow correctly the law, EB2-IN, Ch will become current soon. Till all EB2 become current, EB3 never see any spill over. Till EB3 ROW become current, EB3 IN will not see any spill over. Till that point EB3-In will get only 2800 EB3 visas.

RNC Bows to Bush, Kills Immigration Resolution
    By John Gizzi
Human Events Online, January 22, 2006
    . . .
Given the growing chasm between the Administration and GOP grass-roots activists on the issue of illegal immigration, the Pullen measure could well have paved the way for the most incendiary debate at an RNC meeting since the partys ruling members eight years ago voted down a measure to deny funding to candidates opposed to a ban on partial birth abortion.

    The Illegal Immigration Lobby
    By Don Feder
    GrasstopsUSA.com, January 17, 2006
    . . .
Similarly, every call for immigration reform is answered with lusty shouts of racism by the self-styled champions of immigrant rights.

You want to start protecting our borders? Youre a racist. You think illegal aliens are responsible for a disproportionate share of crime, disease, poverty and social disintegration? Youre a racist. You believe America has a national language, and it isnt Spanish? Youre a xenophobic, hate-monger (even if youre an immigrant or the grandchild of immigrants).

    Threat to Immigration Reform
    San Antonio Express-News, January 23, 2006
    . . .
Illegal immigration is a hot-button issue these days, and calls for a border fence spark fierce support among some segments of society.

That support is misplaced; undocumented workers who risk death to cross the border will not be deterred by a wall.

What's FAIR Got to Do With It?
    By Tom Barry
International Relations Center, January 19, 2006

The House's approval of the Sensenbrenner immigration reform bill in mid-December was a clear signal that the most virulent restrictionists were in control of the immigration policy debate.

Sponsored by Rep. James Sensenbrenner (R-WI), chair of the House Judiciary Committee, the Border Protection, Anti-Terrorism, and Illegal Control Act calls for the extension of a fence along a third of the 2,000 mile U.S.-Mexico border, involves local law enforcement and other government officials in immigration enforcement, and denies due-process of law for immigrants. The bill sparked a spate of international criticism of rising anti-immigrant sentiment in the United States , and raised alarm among immigrant communities and their advocates.

Actually, this is a new rule it seems. We also faced it this time. Airlines have to verify the visa. When I was flying through Air India via jfk and also when I was returning from India, both times my visa on my passport was scanned by airlines official. You will see some guy carrying a laptop kind of device and he/she will scan your visa before even you go for boarding pass. In our case, since visa was expired they asked for Advanced Parole.

It was on Dec 2005 . Luftansa . Chennai - Frankfurt- Dallas . I was waiting for my boarding pass . I handed over my e ticket to the lady at the counter. Instead of issuing the boarding pass , she asked me about my H1B papers. I got confused . Why should I show my papers to this lady ? . Since it was my very first trip to US , I meekly showed her my papers. After that she had issued the boarding pass.

Friends, you may think I am very meek. This was not my first overseas trip. I had visited Japan previously. I didn't want to have fight with her and start my journey in bitter taste from the beginning.

Don't think only Non-Indians treat Indians shabbily. Our enemy is within.

If I happened to see that lady once again in Chennai -------

U are saying - The person's GC category should be same all through out the GC process, irrespective of the technical advancements the person make during the course of the GC process. A person is porting only because he is qualified for the category, U folks are talking as if there is an open slot and everyone is clamoring for it.

U'r logic should be similar to the below scenario..

A person joins a company as a Jr. Engineer, then based on U'r logic he/she cannot become a Manager (which requires an MBA / equivalent) because he entered the workforce as a Jr. Engg. Even though the fellow would've acquired necessary skills and even MBA (going part-time to school), still he/she cannot become a Manager. U are vouching that an MBA who joined few months earlier can become the Manager but not the home groomed fellow. Wow, U'r logic seems to a ground breaking thought process, please extrapolate U'r lawsuit for the case mentioned above. If you win, this might be the most ground breaking decision in US.

Personally I've reported to folks who joined company as high-school grads and worked their way up to Managerial position ofcoz acquiring the necessary college education while working. They have shown up those experience to move ahead of other folks who joined later with higher degrees.

    sunnysurya and rollingflood,
Rather than focusing on divisive efforts why can't you focus on real problem - retrogression. Why don't you work towards IV's goals? You folks joined the forum few months back and have already made great impact. Hope you would channel U'r energy into something positive for the entire community.

    CIS Ombudsman's annual report.

The information might have been posted earlier...

    http://www.dhs.gov/xlibrary/assets/CISOMB_Annual_Report_2007.pdf

page 37 - 44 - detail the problem and proposed solution
the flow chart on page is 42 gives a good description

So , the USCIS says they get 39% positive response from FBI namecheck. Does that mean
for those 39% the GC/Citizenship is denied? I haven't heard much about folks getting GC denied because of critical FBI report. The Ombuds is unable to determine how much of the 39% positive response cases were already covered by other means of check. .
I think their reasoning could be like this "Even if 1 million good guys are put to difficulty because of the false hits, if they can catch 1 bad guy with the process, they will continue to do so". The only solution appears to increase the resources/money.

The Los Angeles Times (11/11, Watanabe) reports that, according to a report from the Migration Policy Institute, there is "a massive 'brain waste' of highly educated and skilled immigrant professionals who potentially could, with a little aid, help ease looming labor shortages in California and nationwide in healthcare, computer sciences and other skilled jobs." According to the report's findings, "nationwide, more than 1.3 million college-educated legal immigrants are unemployed or working in unskilled jobs such as dishwashers or taxi drivers," and "nearly one-fourth of them, or 317,000, live in California." The report also "noted that competition for such professionals is heating up, with other countries such as Canada and Australia moving aggressively to attract them with better transition programs," and "suggested an expansion of successful programs such as Welcome Back," which helps transition immigrants with medical skills "back into the healthcare field."

To me collateral damage to GC is more acceptable than the same to human life.

On economic front, the only person on either side who truly supports free market policies is Ron Paul. He is the one of the few Republicans who actually thinks about balancing the budget. Tax cuts are ok, only if you back them up with reduced spending, without increasing the national levergage. National debt is now at 100% of GDP (in the company of zimbabwe and jamiaca) , 20-30% of future income tax will go towards paying of the interest on Govt tax. It will definitely crowd out future private investments. Look at the history of national debt, and correlate them to the administrations.

"Supply side" tax reductions of Reagan admin were good but even he increased the debt during his tenure. Leveraging is good for private cos (to certain limit, as we can say from recent developments), but not for Govts, as they do not really do much economically productive activity. Keynesian economists have all been hiding in their basement in the last two weeks.

It is just my belief that Repubs dumb down everything.. from education to how to sell a war or economic plan to people.
