    Hi,

    I am currently working in Skilled visa through one of MNC company.I am working for this company for last 4 years and prior to this company i worked in another small company for two years.When I join my current company i provided all the legal document like exp,last two month pay stub and releiving letter and they did BG . They did not find anything wrong with prior employer in last 4 year. recently they found something wrong about my prior employer and asking me providing additional document and unfortunately company is closed or rename. I have told my current employer that i don't have any more evidance of my prior employer.Because of this reason they are asking me to come back india.

    Is there any way that i can take legal action against this company in US because from last one week
    they are harrassing my like anything.

    Please let me know if anyone come across in this situation.

    They are just giving you BS. They are trying to use a fake reason to send you back to India. They might be using this fake reason (BG check) to avoid any legal hassles. Keep track of how they are harassing you, keep a copy of all emails and documents used in correspondence in this matter and complain to DOL.

    In my opinion it is very naive to think that USCIS/DOL just realized that they had 'misinterpreted' the law. ..... The ambiguity of the law for the preference of vertical vs. horizontal spill-over allowed them to do that.


    In a couple of my previous posts I copied the relevant Sections (Sec. 202 and 203) of the INA which specifically states that distribution should be preferentially horizontal. Both Sections should be read together.

    Please note that there is no ambiguity in the law and DOS may just have taken too long to change the US Code or other relevant section of their rules.

    I will definitely be willing to change my interpretation if you can show where the ambiguity in the law lies. I'm definitely not a lawyer so it's quite possible that I'm missing some clause in the law.

USCIS anticipates a substantial increase in the number of petitioning employers that will file Form I-140 petitions requesting Premium Processing Service and seeking labor certification substitution prior to July 16, 2007. The volume of such petitions filed requesting Premium Process Service is expected to exceed USCIS� capacity to provide the Premium Process Service according to the program guidelines.     Well, bad news for those looking for labor substitution. But I believe you can still file I-140 with premium processing if you have your own labor.

    Hello, I can understand your pain as I was in a similar situation as you are. I would recommend to wait for atleast 2 weeks. I interviewed on 28th Dec and finally got the email on 9th Jan and the pp stamped on 10th Jan and took the flight on 12th Jan.

    If you have an upcoming travel which is in next week, please try to reschedule it as it is not certain on how much time does it take in such cases.

    I do not think getting the employer involved into this will help. VFS office will have no clue on this and they will answer only Questions on the process. Writing to the US consulate will also give you a general answer. It is sad that there is no accountability in cases like these. Please keep the faith.

    Can you add which consulate (Mumbai/Delhi/Chennai) you interviewed?

    How come there is pending cases in 2007, 2008 and 2009 for EB2 and EB3 India?

    From the PDF I see the following

    EB2
    2007 after july fiasco - 559
    2008 - 178
    2009 - 9

    EB3

    2007 after july fiasco - 466
    2008 - 88
    2009 - 5

    My understanding is that the visa bulletin were never open for priorty dates from Aug 2007 to till date....EVER..

Y dont we discuss how Kanimozhi's discontent couldn't play spoil sport for the new govt and how Azhagiri got cornered with chemicals and fertilizers (these 2 are not any interntaional fame for an american 'tunnel rat' to know abt them).

    Above all I am here to get some information to bring a company which violates rules to authorities, nothing more nothing less and not here to do any name calling of mud slinging.

    l1fraud. L1s cannot be hosted at client site when the client site manager has supervision on him/her.

    ICE has a historically poor track record on enforcing H1b/L1 rules. Only lately there has been on enforcement on the H1B rules. All that one can do is complain to USCIS / ICE
    etc but they don't do anything then you may have to talk to you senator/congressman etc. Sometimes senator/congressman are also non cooperative.

    Let alone L1, even B1 visa is used like a short term work permit by many IT companies including American IT companies

    FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

    I agree with you. I was once-upon-a-time a vonage customer, then I got reformed. :D
    When you are a customer CS will treat you like God. Once you call them to cancel, they will play all kinds of tricks. They even lied to me about certain things.

    But this 24.99 unlimited India offer sounds really good. I might consider signing up again. :rolleyes:

    I agree with you on this, there is some truth to this that there could be delays when there are multiple filings. In fact this is the first time when USCIS has to deal with so many multiple filings, a very few lawyers have any direct experience with it. From USCIS Standard Operating Procedure, there is a mention of "second filing" (not duplicate filing) in the following places:
    1. Procedural Overview (Page 4)
    2. File Review (Page 46)
    3. Interview Waiver Criteria (Page 185)

    From the link above:
    In (1) and (2) above it says second filing should be handled under the normal process. Although if different A# are assigned case goes to CRU (case resolution unit). But if A# assigned are same, you are more or less processed like a normal case. The last part (3) interview waiver criteria, multiple filing is mentioned as one of the deviations from interview waiver criteria but it NOT the interview criteria itself. In the end processing time for multiple filing is very much up to the discretion of adjudicating officer. Also, I didn't find any reason to believe that there could be issues with security check with multiple filings.
    I think all of us multiple filers can breathe easy if our cases are filed clearly with full disclosure of information without any intended willful violation.

    I am a multiple filer too, my I-485 application filed in early June was approved last week. I hope this gives some reason for optimism for us multiple filers. Good luck to everyone. BTW: I am still a contributing member and will continue to hang out at IV.

    Hi friends,

    My husband and me work for the same company now. He applied in EB3 (India) and PD date with December 2006. I-140 approved and I-485 applied in July 2007. Got EAD and AP for both but still working on H1B (Not used EAD and AP).

    From other company, in 2007, I applied for labor substitution and it is approved yesterday, which has PD Nov 2004 (EB3 - India). One of my friend working for this company and I got the reference last moment and I was not hoping for this approval.

    Now I have to switch to this company as the company management are asking me to join the company. I read many threads in this forum and this thread too about multiple filings of I485s and withdraw one while applying other.

    I read some people had no problems with multiple I-485s. But Murthy's advice is against this while others like Rajiv in favour of this.

    Please advice me what could be the best in my case.

    I have PG in engineering (CS) from India.

    This House member is apparently retiring in 2007 after serving his current term.

    Here is an extract from his article that hits the homerun when it comes to retrogression. (please read this article entirely to get to know what this guy is all about).

    We rarely hear about the long and shameful wait of up to five years facing a person seeking to immigrate legally into the United States, or the legitimate cross-border business that finds roadblocks at every turn. Kolbe consistently pushed the government to treat the people caught in this bureaucratic wastelands with respect. To be sure, he was a strong advocate of tougher border enforcement, but he knew that enforcement should be only a single component of a much bigger strategy.

    This man is honest, candid and outspoken and unpopular:( at home(arizona) because of that. But the keyword here is candid and well-informed:). If the EB retrogression is presented properly to him, he could be an effective voice in the house.
    Now, does anyone live in Arizona's 8th congressional district who can do something here. Arizona's 8th is most of Tucson, eastern Pima County, all of Cochise County and parts of Pinal and Santa Cruz Counties.

    One way "in which we can get more people involved on IV" is to remove some of the barriers to such participation. And the infamous red/green thingie comes to my mind.

    Any updates on when IV is going to get rid of the red/green dot thingie?

    Counting time after I140 approval towards citizenship proposal is already on our table for things to consider as a campaign. For Campaigns like this, we will need massive support than what we currently have. Even recent greencard holders can benefit from it.
    So the first step before we undertake any big project is to get more membership base.

    So let us first figure out ways in which we can get more people involved on IV. Without massive participation no campaign, letter/lobby/phonecall etc will work. We need to really go out of our way and spread the word around so that everyone that is stuck in this immigration mess can join this movement.

    how can it be free..when you pay 25/month?

    I have vonage service since two years and i am paying 24.99/m since two years for unlimited US, canada and europe. They just added india in the international calling list so isn't it free? I am not paying anything extra for calling to india. I have been with vonage for quality and it is personal choice about which service you use and how much you pay for that. It all depends on usage and how much we spend on calling cards or calls to india. If you spend more than $25 on calling to india than this is a great plan if you have internet connection at home.
