I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:
1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.
2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.

This trend chart/volume chart certainly represents both family and employment base applications. Following is my thought process now with keeping both trend chart and teh worksheet in this thread chain together.
(1) In Worksheet USCIS claims total EB pending case 233816 by December 2009. Yet we
have not reached to December 2009. Trend chart claims total pending 279031
including family base applications. Since famaily to EB ratio is unknown I would
consider worksheet's figure as authentic for pending EB based 485 cases. One practical
clue for inclining to do this as I know USCIS has approved tons of green card in
parental family category. Many of my friends have got GCs for their parents in a
relatively very small time frame - 1 year
(2) I remember somehow that out of 775000 485 applications in October 2007, there were
around 300000 application were from EB category based on USCIS's published
notification ( I tried to find it on internet but some how I do not see it now). If
somebody has a more solid proof this stats from which we can derive nearly accurate
ratio we may consider those stats. But as I mentioned in point 1 USCIS seems to have
cleared more family bassed 485 with comparison to EB categories I would just
assume for now that 60% preadjudicated cases and "awaiting customer action"
and "New receipts" are from family category and 40 % are from EB category. Total
preadjudicated cases per trend chart is 178418. 40% of that around 71367 - for the
sake of easiness let's make it 71500. This way "awaiting cutomer action" cases for EB
categories could be around 18-19000. "New receipt" cases could be around 18000
roughly.
3) Now total EB based 485 cases by July 2009 could be = Pending cases + preadjudicated
cases + cases awaiting customer action + new receipts = 233816 + 71500 + 18000 +
18000 = 341316. Just the sake for simplicity in assumption we may consider total EB
based 485 workload with USCIS around 350000.
4) "In general" the first lot who will come out from this gutter is "preadjudicated" then the
lot "awaiting customer action" then the "pending ones" and then " new receipts"
Now based on my talk with USCIS guy I can state that USCIS generated RFEs innear past for many cases as apart of preadjudication process, particualrly for may AAC21 usage related cases - Asking for proof of employment in the same job classification. According to that talk if USCIS gets required response to the RFE then USCIS settle that case in a "preadjudicated" shelf. In other words the AC21 guys who got the RFE - responded and case is resumed - most of them should be on "preadjudicted" shelf. If we call USCIS generally let us know that whether our particualr case is preadjudicted or not.Lucky one may get that reply in first call and somebody may have to try calling multiple times.

I have a WAC number and petition approved in Feb 07. Stuck here for 1 month, 18 days and counting. I called DOS and didn't receive a positive response. Will try calling KCC tomorrow.

Does anyone know if vonage can be used as a phone card. Say if you want to make an international call from your cellphone using vonage account.
I dont think they have the calling facility with the reference to vonage account.....I have chatted with customer rep and he confirms me the same....this was few days back...not sure now...if any body has new info, update here.......

I am trying to find out if filing a DHS-7001 has actually resulted in resolution of the approval for anybody. i see a lot of folks requesting an ombudsman to intervene but wasn't sure if anybody got a positive response back -- like the case is now resolved or something.

And submit that along with high school mark sheets etc. Are there any other things that could rectify this error.
2 choices... you can change your name to "girl" OR just get "Birth Affidavit", you should check with your lawyer on the latter.

Look at sections 312, 313 and 311 (H1b cap). Looks like cap will be removed for science, tech, math etc...and maybe for families as well, + cap is going up. So overall very very good news...or am I seeing things?

OK....wait till next week for an outright refusal on EAD.
once that happens.....explore the option to file suit......
they first stated that they had instructions from their legal team that they have too much hassle with EADs causing problems, so they dont hire ppl with outside EAD. When I asked them to reconsider they said I dont know for sure, lets see what the legal team says.
It seem to me that this hr person did not make up the refusal on their own, but had previous precedents to go by or had been given explicit instructions.
My fear is that they will come back with a clearer explanation of why they cannot offer employment based on the EAD.
I am getting really really upset about this. If I had known about this EAD refusal thing I would not even have gotten out of H1 and would have continued to work...

Please don't get pissed with people telling you right or wrong. My take on EB-3 issue is write to Rep. Zoe Lofgren in large number, as far as I know she understand the Retrogression mess as a whole, but she's not aware the typicle problem faced by EB-3 because of the asylum(245i) given by the congress. If she would use this logic, she can go farther...
Some one gave me this comment saying
Show me where have I undermined IV efforts? And show me nonsensical or counterproductive posts that I have made -- that is, nonsensical or counterproductive to the cause of upholding the law (not pandering to a particular employment category/chargeability area).
I have done my homework, and I have understood the law properly. I have time and again given logical proof, along with the text of the law, as to why EB3 is eligible get the EB1 numbers at the same time as EB2. On the other hand none of the detractors have provided proof, or material that shows EB3 does not qualify.
And for all those holier-than-thou EB2, what is about the letter campaign to get NSC/TSC to process application according to PDs (no lawful basis for that), and asking the removal of NSC bosses and what not. You seem to have different standards when you are suffering, and when others are suffering. There is a word in the dictionary for that, look it up.

Not only consulting companies but genuine companies in the software arena will also face trouble. If I interpret it correctly, most new hires at places like Google, MSFT, Amazon etc. even if having MS from top-notch universities in the US can apply only under EB-3 as their job description will fall in Job Zone 4.
On the other hand somebody having a non-IT or CS degree from a mom&pop University can find a job, state its "research" and upgrade to Job Zone 5 and apply under EB-2.
I wonder how this will fly with the affected companies?

They have not specified anything like my prior company is fake in any of the communication email.They are asking me come back because they find something wrong about my prior company after four year and i am not able to provide more evidence.During four year i worked in 10 to 15 project for diff client and for each project first they did BG and put me in project.Now they are asking me that provide some more evidence or come back to offshore.
I know if i come back to india they will give me layoff from company.In this situation how do i fight with my company.
Please any of guide me if any of member come across in this situation

EB-1, EB-2, EB-3 doesnt matter, let's get the calls going. If you don't want to be at the same stage next September, please pick up the phones and call. GC sooner or later, it's your choice! Make it happen!
