I am EB2 and have a Masters but I don't support your case or even the basis of it. Mostly it is because I don't think MOST of the folks who use PD porting are doing it illegally or even cutting through the line undeservedly. If I am not wrong, these folks will have put in the time (work exp wise and/or added higher education) and should rightfully get the position certified as EB2.
Now granted that there are always a small minority people who genuinely are not deserving. First, can you define in your view what kind of PD porting is unethical?
Additionally, can you back up your claims by providing any kind of stats of such cases per year and how much impact it really causes to the GC wait time of those already waiting in queue for EB2? Are they that significant for you and Rolling Stone to feel so wronged?
In conclusion, unlike the unjust labor substitution process, your case is not convincing because I don't think most people availing PD porting are doing anything wrong legally and ethically. I would love to see stats and examples though.

If they decide to cut-off some day next week can't believe how a day or two would make a huge difference in someone's lives. This is very cruel. We have to react based on the infomration we have and it keeps changing every day. So every time I have to run to my manager/director ask them to escalate to HR and they talk to Lawyer. I look like a guy pushing panic button all the time but in reality if we don't act quickly will regret for next few years. Never had a such a bad July4th holiday :(

I am planning for a trip to india and get my first visa stamping done some time in may. My visa was approved in july 2007. Does anyone think that this issue will prolong till may? Or will all these database updates for the PIMS verification checks be complete by then? Any inputs will be highly appreciated. Thanks.

I guess we'll need to ADD to that number:
1. BEC stuck folks who could not file in July 07
2. PERM approvals starting August 07
to the 47,728. Plus multiply by 2.1( for dependents ). That'll give the total VISA numbers required for this category to make it Current.
If I have to guess-- (1) would be very less, may be 100-200 max
(2) around 5000 ( just a PUMA)
So, there are about 53000 EB2 I applications. and 2.1 * 53000 = 111300.
If we can create 111300, EB2 I visas then it'll be CURRENT. easy:)

My lawyer tried calling USCIS to find out the details and they mentioned they are still processing the July 2nd cases and application are stored in 4 different warehouses.
According to her at this point we can do nothing but wait until they finish processing all the application.

CADude and others... maybe your efforts are paying off. What I learned in this process is that have faith in your application filing. If everything is fine you'll definitely get the receipts. It may be either next week or in 2 weeks.
Couple of things...
1) Calling USCIS is useless...
2) Look for checks for cashed....
3) Keep in touch with our pending group. I gives you support and motivation.

It was on Dec 2005 . Luftansa . Chennai - Frankfurt- Dallas . I was waiting for my boarding pass . I handed over my e ticket to the lady at the counter. Instead of issuing the boarding pass , she asked me about my H1B papers. I got confused . Why should I show my papers to this lady ? . Since it was my very first trip to US , I meekly showed her my papers.After that she had issued the boarding pass.
Friends, you may think I am very meek.This was not my first overseas trip. I had visited Japan previously. I didn't want to have fight with her and start my journey in bitter taste from the beginning.
Don't think only Non-Indians treat Indians shabbily. Our enemy is within.

LC substitution was wrong because it became a business thing for some unscruplous employers who started to sell LCs and get people to work like slaves. That being said I have no ill feelings towards people who used the opportunity to get their GCs faster, albeit by puttting in more of their money and/or working like slaves for a better life in the future (hopefully). EB3 to EB2 portability is someone trying to better his/her life after suffering in the queue forever and I have no issues with such people.
I, therefore, cannot support this case. BTW, I am an EB2-I with Sep. 2006 PD.

As anchorman and managing editor of the show Lou Dobbs Tonight, Dobbs has used his nightly program on CNN to help make immigration one of the most discussed issues of the 2008 campaign. Dobbs describes himself as an independent populist. He titled his latest book Independents Day: Awakening the American Spirit. His previous book was titled War on the Middle Class: How the Government, Big Business, and Special Interest Groups Are Waging War on the American Dream and How to Fight Back.
AMY GOODMAN: Lou Dobbs also has his detractors, especially when it comes to immigration. He has been called the most influential spokesperson for the anti-immigration movement, and he�s been accused of being a fearmonger who vilifies immigrants and promotes xenophobia.
But Lou Dobbs�s message has struck a chord with many viewers. Lou Dobbs Tonight is the second-most-watched program on CNN, and there�s even talk that Dobbs might make a possible run for the White House. Wall Street Journal columnist John Fund reported last month friends of Dobbs say he�s seriously contemplating running for president as an independent.

LOU DOBBS: Great to be with you.
AMY GOODMAN: Are you running?
LOU DOBBS: Absolutely not. It�s the last thing I could imagine. If I were a candidate, I can assure both of you that I would be the candidate of last resort in this country. That�s about 300 million people in line ahead of me.
AMY GOODMAN: Well, you�ve written the book Independents Day. That�s with a �ts� at the end of �Independents.�
LOU DOBBS: Right.
AMY GOODMAN: What is the main thesis of this book?
LOU DOBBS: The main thesis is that both political parties�the Republican Party, Democratic Party�have failed the American people, have, rather than held up our central fundamental national values as the standard to which all of our public policies should repair, has submerged them in trivia, wedge issues, and partisan blather and nonsense that is ultimately destructive to the American dream.
AMY GOODMAN: What do you think are the most important issues today?
LOU DOBBS: The most important issue in this country today is representation of the American people in Washington, D.C., which is being denied right now by corporate America, special interest, group and identity politics that are submerging the will of the majority in this country. The fundamental tenet of any democracy is representation of the will of the majority, and that is being denied through elitists in both business and government and politics. And we have to fundamentally examine where we are and where we want to be going over the course of this next century. And that is not happening, not in the presidential campaigns of both parties. It�s not happening in Washington, D.C., even though we have a government in which the Democratic Party is leading the Congress, and the Republican Party, the White House.

Of course the flower campaign worked.
How many times have we been able to elicit a response from USCIS? Or queries from so many different news organizations. The idea was to take a collective action and get media attention and that's exactly what we got, didn't we?

Can someone please post the steps to open an SR and get an Infopass? I may have a biometrics appointment coming up soon. Can they help with application status questions?

To create SR,
Call the toll free number and select some options for you to reach a live representative.
Tell them that you are waiting for a very long time and needs update.
You need to have your receipt notice with you. And your wife too (matters only if you are married, just for the sake of it, do not bring in anyone else's wife...just kidding)
If your wife is not with you, they will create the SR for her. Hence suggested. Take down the name of Rep and the confirmation number.
That's it.
