I lost my job about a month ago with fortune company where I had my H1 and then I filed to transfer my H1 to the GC filing company. It got approved last week. They even seem to have sent the I 94 with the H1 approval.
I have a visa from the earlier company(fortune company) till dec 2009 in my passport. Do I now need to get a fresh visa again with the new (GC) company that has sponsored my H1. Or is the visa validity in my passport is good enough to work even for the new employer?

Attorney is correct, when the requirement is Bachelor+5yr means Bachelors should be 4yr degree, Remember there is a big difference between Bachelors degree vs Bachelor degree equivalent;)

I am having an option of joining a new employer with whom to file LC. Company is not very big 50 employees and started in 2002.
I am very worried about the stability of the company. This kind of companies are normal or I am just unneccessarily imagining and worrying ???

Today I will be giving a presentation on immigration law along with my colleague, V. Thomas Langford, to the Air Force JAG serving at Travis Air Force Base in Fairfield, California. The Air Force JAG Corps are lawyers who provide legal advice to those serving in the Air Force.
Our training today will focus on the basics of immigration law. We will be covering family-based immigration law and outlining the procedures involved in petitioning for a family member to immigrate to the United States. We will also be talking about the Violence Against Women Act ("VAWA") and how an individual may self-petition for immigration status if he or she has been the victim of abuse or mental cruelty. Finally, we will discuss the naturalization laws as they apply to those serving in the military at a time of a conflict.
It seems that I always learn something while preparing for a presentation. While preparing for this one, I learned that staff from USCIS in Sacramento go to Travis Air Force Base twice a month to interview applicants for naturalization and administer the oath of citizenship on the same day. Kudos to USCIS for taking the time to do this. My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.
My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?

I know this has been discussed a lot but I need advise or suggestions..
I am under Eb2 with priority date of Jan 2007 (labor and I140 approved) waiting for date to be current so that I can file I485 AOS....
My wife wants to convert from H4 to F1 for coming Spring 2011 so that she can take assistantship..
Is it advisable to change status to F1 with priority date so close..? does it cause any problems for her I485 application since F1 status is Non-immigrant category..
Please advise..

Hello everyone,
Can anyone define who (what) are the nonprofit organization that would be the exempts for the regular H1-B Cap?
USIS's website says they are the "institutions of higher education or a related or affiliated nonprofit entity" or "a nonprofit research organization or a governmental research organization."
I understand colleges and governmental organization are included, but what else qualifies for this category? I mean there are millions of nonprofit orgs...from the one that does important research for a state to the one that helps promoting the US. film industry to the one that cleans up streets for free....I'm just so confused.
Any little help would be most appreciated.

I don't see any issues for your wife to convert to F1 now and then apply for I-485 when your PD gets current. However once she applies for I-485 then it will be risky to apply for extension of F1 or stamping F1 as F1 does not allow for dual intent and she would have shown her intent to immigrate. So after applying for I-485, it will be advisable to switch to EAD / AP for work and travel.

Company A is in talks with company B for takeover of the division I am working in.
I have a offer in hand with company C. They have filed for ETA 9035 and if i understand it right, i have to use AC21 portability now
What I need to confirm is:
1. Takeover of company A's division by company B, will it affect my GC process? What can cause issues here?
2. If i stick with company A, it should be good for now, but maybe some layoffs after merger. Whats the best thing to do to maintain my GC process?
Please let me know as my join date for company C is next week

We filed 2 - 485 applications for each of us(One is primary in one set(Husband) and the other one is primary as second application(wife)). Both of our lawyers said it is ok to file like this. Once we get the 485 approval in few years we have to withdraw the sencond application.

Please do not rely on Indian Media for immigration news.
They have covered their bases by putting "May" in the headline. "May" increase visas.
There is already a discussion that happened about this on another thread. Please search the forums for the article before starting a new thread.
And for heaven's sake, please dont look for immigration related news in Indian Newspapers. They dont know that congress has two chambers : House and Senate. And they dont know the common basics of legislative process in USA.

I am working for a company (A) and I have visa stamp for company A until Dec 2010. I am planning to switch to company B soon. I was wondering if I need another visa stamp with company B or the same stamp will do. I am planning to visit India in February.
