My lawyer checked my application type as
"h", and stating "Spouse has an approved I-140"
Since I am filing as dependent. Should it be "b" " my spouse or parent applied for adjustment..."
Does it hurt to choose "h"? Thanks!!
If you are a dependent, you should probably choose (b). I chose (b) for my dependent wife, which is what my attorney recommended. Don't know about (h), but why complicate matters?

NIW 140 approved last year. EB1a 140 RFE/485 pending. Can I file a new 485 for NIW? or do I have to withdraw the pending 485 before filing the new 485?

The US Department of State has released the new Visa Bulletin (http://travel.state.gov/visa/frvi/bulletin/bulletin_4575.html) for October 2009. In family-based categories, there is very slight movement forward, but just by a few weeks or months in most categories. However, Family 1st Preference for Mexico moves forward by 17 months
Employment-based categories remain "Current" for all 1st preference applicants, and for 2nd preference from Mexico, China, and countries other than India and China.
The biggest change is that the bulletin once again lists priority dates for 3rd Preference and Other Workers. These categories have been "Unavailable" since the May 2009 bulletin. Unfortunately, the priority dates listed on the October bulletin are all at least a few weeks behind the dates listed the last time, in the April bulletin. This may be the Visa Office being conservative in its first allocation of numbers for the new fiscal year. Let's hope so, and hope that they move forward in the next few months.

Hi,
I am trying to find health insurance for my spouse who is in H4 visa.
Could you please let me know if I can buy the health insurance only for her? Is there some law which states H1B visa holder also needs to buy the health insurance along with the spouse?
BTW, I am living in NJ.
Appreciate, your inputs and pointers on this issue.

Since all of this has already happened, harping on what could had been done is useless. From my limited knowledge of immigration, I think you have no choice but to file another PERM and forget about your earlier case.

not sure about I-140, i think it should be ok to mention your spouse name but check with your immigration lawyer about this.
NOTE: as far as i know, if your wife is in H4 visa, you can file her AOS (I-485) as your spouse. But if she is in F1 visa, you CANNOT file her I-485 as your dependent along with your I-485 since she is in F1 student visa. but check with your immigration lawyer about this..

Hi,
I need suggestion on travel.
I have applied AP for my wife on April 16 and still waiting. We have expiated her AP last week, still no updates. She has an emergency travel on June 20th. Her previous AP is valid till June 24th.
Can she travel out side on June 20th and come back with new AP when approved (I can mail her the new one once approved) or dose she needs to be in US until the new AP is approved?
As the old AP is valid till June 24th, dost it mean that they will approve the new one only after June 24th?
As this is an emergency I need your suggestion please...

Hi,
I am planning to file EB2 and port my EB3-I140 PD. My current position is System Analyst with EB3 job requirement. I can get a promotion but that doesnt qualify for EB2 job requirement. So I am planning to move to a different position, Research Associate which qualifies for EB2(it requires masters degree) with the same employer. Can I file EB2 with this position and port my EB3-I140 PD? Advice pls.

I know Steve prefers to go flashless and knock the ISO up to 1600 but then he's usually shooting bands with huge light shows. Shooting these bands in small clubs who don't have an extravagant light show without a flash I find most of the time my results are too dark. I first try to use the bounce flash method and if that doesn't work out I'll use it straight on but with a lower setting to where it doesn't completely wash out the color of the stage lighting. But yea, that would be my critique, 3 of 4 of your shots are on the dark side.
