Hello,
I am stuck in India (along with my husband who) after leaving USA where I am living for over 5 years. I just came for 2 wks here in India to get stamping done at the Chennai Consulate. They kept my passport and said they will give visa, in next 3-4wks..Its past a month and 3 wks.. I am force to live with relatives. I can't even go to my home country without my passport. Everything I own is back in USA. How do I get back to it? I am on H4 and my husband is H1B. I am holding another country's nationality. I can't even visit my home country without my passport. Why did the Consulate kept the passports for this long? :confused:Why are we being treated this way?? Why didn't they do a security check where I was living for over 5 years? I am so frustrated being stuck and worry about my home left unattended back in the US.

Did you contact the consulate if they already sent it? Maybe it got lost in the mail or was returned to the consulate. Also, could be background checks. In any case, you should contact, VFS or the US Consulate to get answers. I think numbers for VFS/Consulate should be available on the consulate website.

This move in visa number is dramatic and not to mention scary. It also has the hint that dates will retrogress in FY2008, there is no way that everyone will be processed by the end of this year.
If I were you I would keep the earliest priority date and not worry about the category its in, but then its just me and my choice :). You can judge yourself.

My question is regarding Citizenship. My mother married my step father in the year 2000. They have 2 children one is 7 the other is 9. My mother did not adjust her status right after they married. she waited a few years. She received her green card on November of 2006. "the one that renews every 10 years. This year she separated him because she cheated on her. They are not legally separated or anything like that. She wants to become a US Citizen but we think it might be a problem since this year they did not file taxes together. When she did her taxes she checked the box that says shes filing married but separately. He does not want the divorce but she does. I told her she should hold of on any divorce and see about getting her citizenship first. What complications can she have since this year they did not file jointly. I appreciate your time and any input
No she should not have any problems since she has 10 year validity green card(One with Condition removed). IF the citizenship is applied after three years green card they will check the validity of the marriage. Usually if you apply citizenship after 5 years there are will not be questions about marriage. if you have the issues apply 2011

Just ensure that they will be able to document enough ties back home for officer to feel comfortable that they would return. From your side, provide evidence that you can afford their stay. Barring that, I see no reason why going separately or together would make a difference.

Mine got rejected on grounds of incorrect fees (there was a single check)
my wifes app turned up after a month or so
we refiled and got the receipts
I am now trying to find out what to expect for EAD and AP
I wonder if special handling cases get a better turnaround
Keep me posted with what happens with you- and maybe we can start to geta n ide as to what to expect next

I entered into my 7th year few months ago and I have an approved I-140 and also 3 year extension.
I dont have any documents of my approved labour or I-140 and I dont expect to get it from my employer either.
Q1) In case I change my employer and go for stamping, will he ask me for any of the above documents as approved I-140 or Labour?
q2) In case I happen to start my GC process again( assuming in yr 2007 in EB3), will how long will it take ( approx) for my PD to become current ?

Hello all,
I am currently on H1B visa working for an IT company. I have got an admit for this Fall to do my MS and I was planning to study using my EAD. Now there seems to be some risk in using my EAD and so I want to apply for F1. I have applied for I-485 (Adjustment of status) along with my husband's green card application.
My question is:
1: Is it a problem to apply for F1 if my I-485 is pending approval ? The reason I ask is, F1 is a Non Immigrant visa and I-485 is for a green card (which is Immigrant visa).
2: Would my F1 application cause my 485 to be denied or vice versa ?

Hi! I hope this is the right place to post this. If not, can you please tell me where it should be posted?
We are caught in a terrible comedy of errors, but unfortunately it is not funny all.
My husband is from Turkey, and was/is here on an F-1 visa. To make a long story short, we filed our I-485 & I-130 applications shortly after we were married. Months after this, deportation proceedings were (wrongfully) initiated against my husband.
While we were waiting for our court date to have the deportation proceedings terminated, USCIS at the NBC denied my husband's I-485 for the sole reason that there were deportation proceedings against him.
The deportation proceedings were terminated with a note on the paperwork from the judge that the charges were wrongfully initiated. The judge asked the Federal attorney to ask CIS to help us in NY, but NY office advised they can't do anything since this decision was made in Missouri.
At this point, my husband has not been able to work (work document denied also, of course), the government has cost us $1,000s of $$ in attorneys, and we do not have money to pay them their almost $1,000 to start the I-485 process over again. We need our original case reopened and approved.
Oh, and before deportation proceedings were terminated, but after the I-485 was denied, we passed a Stokes Interview which was requested through my I-130 due to the deportation proceedings. My I-130 has been approved.
We have filed an I-230-B for appeal, but without the fee. So we have no receipt letter nor case #. We have been told by our lawyer that we need to get the help our our U.S. Representative, Anthony Wiener. However, a friend of mine, who helps immigrants in another state, told me we need to work through our senator, Chuck Schumer's office.
Is there any advice on working through a representative's or a senator's office to re-open/ investigate a case.... which is more effective, faster, etc?
Is there anything else we can do on our own or have our attorney do?
Right now, I'm fed up with our lawyer, and do not feel we are getting enough information from him, or perhaps he is not qualified to answer my questions; so I am seeking other advice.
Any advice is welcome.

Most of the RFE's for AP are for photographs if filed online. They are probably asking for latest photographs that you would need to send. It quite common.

As I will not be on H1B and neither I have Green Card ?
I talked to lot of people about using AC21, nobody is clear.

As far as I know, USCIS considers CP as abandonment of I485 app. I am not sure you will be able to convert back to I485 again. Also, I think you will lose all your AP/EAD benefits. Check with a lawyer tho.

transfer your university H1B to company H1B (without waiting for Oct1)

I am thinking of applying for California state unemployment benefits. Here are my questions
1) Is there a risk that the EDD office could forward this information to USCIS
2) If the USCIS comes to know about this then is there a risk that they may issue a RFE for an updated job offer and subsequently deny I-485.

My friend SS moved to Detroit, recently from Singapore on a H1-B Visa valid until Sep 2009. He is a product owner in a multi national company there. SS moved here and could bag 2 offers based on his Vast experience and Extraordinary skills. One in Detroit, Michigan, the other in OKC. He wanted to take the offer in MI. He gave a driving skills test before Jan 22, got a TIP(Temporary Permit), joined in a driving school to learn/practise driving. As per his TIP, he is eligible to give a driving test on or after Jan 25 2008. He gave the road test succesfully. The SOS denied to give him a license since he does not have a Green Card. All his money and time for driving classes is waste. He could not drive to work if he lived in MI. Govt does not provide any good public transportation. He did not want to fight more and waste his time with SOS reps. He moved over to OKC to take his second job offer. There is no such foolish rule yet in OKC that denies Driving license to LEGAL NON-IMMIGRANT WORKERS & LEGAL STUDENTS. Michigan lost another job. This law is not good for a state already in recession and a state with unemployment rate much greater than the national average. We ask the Governor and SOS to focus on more important economic woes of the state than brain less interpretations of the laws.
