The moment I get sufficient number of people I am going all out.
But as a compromise, I have got a very simple and easy way out...I can tell you one thing, I do have a case which does not require any law change but just the interpretation of it.
Make sure that 5882 is successful. If it proceeds, I will back down. It is a shame that among 25K members raising 5K becomes a challenge.
This goes on to show there is no community. If there is not community then I have to look after my interest.
Stupid is as stupid does
How about going after EAD's, because of the 2007 july fiasco many people were fortunate enough to get an EAD, now they are competing with you in the job market....how about filing a law suit against that ? to cut the competion ....looks like you have plenty of time.

AMY GOODMAN: Another guest that youve had on the shownow, this is a very important point, and this is one that you would agree that youve covered, and that is Arizonathis is very importantthe Protect Arizona Now referendum. In late 2004, it was revealed that the new head of the national advisory board to Protect Arizona Now, an anti-immigration organization, was a longtime white supremacist who was also an editorial advisor to the racist Council of Conservative Citizens. Although Virginia Abernethys controversial selection was reported prominently in virtually every Arizona paper, and despite the fact that Lou Dobbs heavily cover the anti-immigration referendum that Protect Arizona Now was advocating, you never mentioned the affair at all, her controversial selection as head of this group.
LOU DOBBS: And she was featured in how many reports?
AMY GOODMAN: The point is, you covered Protect Arizona Now extensively, and this is certainly significant, when it turns out that the head of the board of Protect Arizona Now is
LOU DOBBS: And when was the last time she was on the show?
AMY GOODMAN: No, the important point is, you didnt report the news of this very controversial
LOU DOBBS: Is it possible
AMY GOODMAN: racist woman who headed Protect Arizona Now, which was virtually in every Arizona paper. The question is
LOU DOBBS: Concurrent with our reporting?
AMY GOODMAN: what you report and what you dont.
LOU DOBBS: Concurrent with our reporting?
AMY GOODMAN: Of course. This is in 2004. The point is, what you report, Lou, and what you dont report.
LOU DOBBS: Well, you know, Amy, I dont know what to tell you, because, you know, based on your focus here today, you have focused on probably three or four reports, as best I can figure, out of more than five years of reporting on the issue. If that smacks at all to you of reasonable proportionate journalism on your part, I mean, God bless you. If thats what you believe, God bless you. But I think youre coming from an ideological position that has just absolutely skewed that perception and that perspective.
AMY GOODMAN: I admit my ideological position, which is that I think that the Council of Conservative Citizens is a racist group, and its problematic
LOU DOBBS: OK. And I think that you are a wonderful, pure and absolute infallible human being.
AMY GOODMAN: not to identify guests that you have on your show that are connected with this group.
LOU DOBBS: Unfortunately, I am a fallible, and I am a man who has made some mistakes. But the reality is, the body of work stands for itself, and you know that. And the reality is, the facts are irresistible. Illegal immigration into this country is absolutely not in the American interest. And that is a reality youre going to have to contend with.
JUAN GONZALEZ: Lou, no, that fact is not clear. You know, first of all
LOU DOBBS: Not to you.

May be it was updated on the website on 25th Aug 09, System date should be present on the report, Report with out date on it is meaning less, I hope the USCIS IT team will understand that, I dont understand what kind of reporting specialists USCIS hires, that is a fundamental thing USCIS should know, Report should have a system time stamp on it saying when it was generated.

Its interesting that July 2nd apps have not been receipted yet. I made two applications (based on the same I-140 from TSC because of the July fiasco), one on July 2nd and one on July 19th.
You can see the first application details in my signature. My second app's checks cleared the bank on 09/12/2007. This is the application that reached NSC on July 19th - the receipt is from TSC.

Good suggestion, I didn't ask about EAD, I will check next time. But I guess evantually EAD would be revoked after I485 is denied. I think H1 is a backup plan if MTR denied and till appeal is decided..
I am sending letter CIS ombudsman shortly.
well, EAD is denied when MTR is denied, makes sense. But if you see the information posted by 'desi485' in this other thread (http://immigrationvoice.org/forum/showpost.php?p=302334&postcount=17), it may remain valid till validity. This is indeed confusing though. Please ask your lawyer and share with us everyone here.

Fact-Checking Dobbs (http://www.democracynow.org/2007/12/4/fact_checking_dobbs_cnn_anchor_lou) CNN Anchor Lou Dobbs Challenged on Immigration Issues Democracy Now, December 04, 2007
Guest: Lou Dobbs, anchor and managing editor of CNNs Lou Dobbs Tonight. His latest book is Independents Day: Awakening the American Spirit.
JUAN GONZALEZ: CNN anchor Lou Dobbs may be the most important person in the 2008 presidential election aside from the candidates themselves. Thats the opening line of a recent column by Christopher Gacek on the website Politico. Gacek goes on to write, The bundle of concerns that Dobbs and his audience have about globalization, trade, diminished American sovereignty and immigration will be ignored by politicians at their own peril.
As anchorman and managing editor of the show Lou Dobbs Tonight, Dobbs has used his nightly program on CNN to help make immigration one of the most discussed issues of the 2008 campaign. Dobbs describes himself as an independent populist. He titled his latest book Independents Day: Awakening the American Spirit. His previous book was titled War on the Middle Class: How the Government, Big Business, and Special Interest Groups Are Waging War on the American Dream and How to Fight Back.
AMY GOODMAN: Lou Dobbs also has his detractors, especially when it comes to immigration. He has been called the most influential spokesperson for the anti-immigration movement, and hes been accused of being a fearmonger who vilifies immigrants and promotes xenophobia.
But Lou Dobbss message has struck a chord with many viewers. Lou Dobbs Tonight is the second-most-watched program on CNN, and theres even talk that Dobbs might make a possible run for the White House. Wall Street Journal columnist John Fund reported last month friends of Dobbs say hes seriously contemplating running for president as an independent.
Lou Dobbs joins us today in our firehouse studio for the hour. Welcome to Democracy Now!
LOU DOBBS: Great to be with you.
AMY GOODMAN: Are you running?
LOU DOBBS: Absolutely not. Its the last thing I could imagine. If I were a candidate, I can assure both of you that I would be the candidate of last resort in this country. Thats about 300 million people in line ahead of me.
AMY GOODMAN: Well, youve written the book Independents Day. Thats with a ts at the end of Independents.
LOU DOBBS: Right.
AMY GOODMAN: What is the main thesis of this book?
LOU DOBBS: The main thesis is that both political partiesthe Republican Party, Democratic Partyhave failed the American people, have, rather than held up our central fundamental national values as the standard to which all of our public policies should repair, has submerged them in trivia, wedge issues, and partisan blather and nonsense that is ultimately destructive to the American dream.
AMY GOODMAN: What do you think are the most important issues today?
LOU DOBBS: The most important issue in this country today is representation of the American people in Washington, D.C., which is being denied right now by corporate America, special interest, group and identity politics that are submerging the will of the majority in this country. The fundamental tenet of any democracy is representation of the will of the majority, and that is being denied through elitists in both business and government and politics. And we have to fundamentally examine where we are and where we want to be going over the course of this next century. And that is not happening, not in the presidential campaigns of both parties. Its not happening in Washington, D.C., even though we have a government in which the Democratic Party is leading the Congress, and the Republican Party, the White House.

Thanks, but could i still file for a concurrent AOS even though i am currently in the country on a AP?
As far as I know, FB and EB are completely independent of each other. As long as you can prove that you have been in legal status all along, there is nothings stopping you from applying for AOS based on marriage. However, none of us here are legal experts on such niche immigration issues since there wouldnt be too many of us in that situation; so consult an expert attorney asap. In such matters I would not go by advise on a public forum.

I think the division of Eb2 and EB3 will be over when oct VB comes. Mostly Eb3 will go back 2003 or 2004 and Eb3 date may be 2002. At that time there will be unity.
The current visa bulletin says EB3 PDs may go back to the level that was in June 08 visa bulletin or worser. So it is very likely that EB3 will be anywhere between Apr 2001 to Nov 2001. Personally I would be happy if it remained at least beyond May 2001.
I dont see EB3 moving to 2002 unless USCIS wants to agressively move it forward, so that they can continue their unfair trend of procesing some out of order low hanging fruit cases in EB3 category, just because they are sitting on the top of their applications pile, even if they had much later PDs. Just like they are doing with EB2
What will unite people is to fight against the common pain point... *Unfair advantage given to out of order applicants* , whether it be EB2 or EB3, who are much later in the queue, but some how are on the top of application piles, and easily accessible to IOs- who are making DOS move the PDs, just so that they can clear of their tables by approving these cases, rather than trying to access applications in FIFO and follow a fair process.
The whole EB2-EB3 divide arose out of this unfair practice of USCIS. Which just on their whim move PDs forward , be it EB3 or EB2. It just happened, that EB2 date has been moved more aggressively, probably because there is less backlog there. But looking at all the EB2 people still waiting with 2003, 2004 PDs while 2006 are getting approvals, indicates that the real problem is USCIS not doing due diligence to identify the right cases to be processed next and get the exact count of such cases.
Just asking them to recapture visa numbers or cyring foul against wasted numbers etc will still not solve the problem unless we also FORCE them to follow FIFO and process cases FAIRLY. And do their due diligence to spend some time and put their application piles in proper order. Otherwise USCIS will continue to use these recaptured visas and use them to approve FU***&G Out of Order cases and manipulate & play the system to achieve that by jumping around the PD up/down/'U' and what not, just so because it is *convenient* for them to do so.

I called yesterday and spoke to an IO at TSC.. she says I am seen pending for name check as of Oct 17.
I am a July 2 filer.
CAdude.. I have a question for you though.. Did your notices show receipt dates of 2nd July or different.
I spoke to my lawyer about getting it fixed.. but they never responded to me back.

Thanks for your red dots... May I ask, what do mean by becoming eligible?
If they can file in Eb2 , shouldn't they stand in the end of line.
Reason most people filed in EB3 was that it was thought that their application will be subjected to less scrutny and had higher chances of success. Also, so far EB3 has been moving in tandem with Eb2, so it did not matter.
Dude. I am US educated & EB2....1st I didnt understand what u were calling people for.
Man this is the story of the Indian crab in real life. If someone becomes eligible to interfile as EB2...why should you be against it?
I am totally against ur proposal...and am giving u red dots ok.

Ganguteli, why do you keep on questioning everybody's intentions all the time. the other day, I had posted about L1 exploiting the loop to file GC in EB1 and your answer was plainly stupid and irritating - "I would have done the same thing if I had a chance"....
There is nothing wrong in exposing any kind of visa fraud...I came here on F1 10 years back and still in line for GC after getting masters from a decent school and working with major employers. What is wrong in making sure that it is FIFO....

America will fly even higher with or without India and chinese those days are gone, look into the future. In the past not many american used to take science and Technology filed but now its different.
I beg to differ on this argument: I am recent graduate from a top engineering school. In my class (class size varies according to the course, anywhere from 80-120)
The only people who took engineering were ones sponsored by compaines like Boeing and Raytheon and that too they were always above 35.
Of these in a class of 40, i would find one american. In my undergraduate courses, there would be 3 in 40. Of those atleast one or two would be pursing double degrees - Music and Science etc etc ..
So... fact is that 95% of the american youth hates math and science in college. Just a look at companies in the bay area will tell you more.. most of the Americans in technology sector are all over 35. Very rarely will you find a fresh grad hired in these companies because they are not available.

I beg to differ on this argument: I am recent graduate from a top engineering school. In my class (class size varies according to the course, anywhere from 80-120)
