Hi folks
We have applied for COS for my wife from H4 - F1, and yesterday we got approval.
(TOOK ONE MONTH APPROX),
Now the question is,
I AM AWARE THAT SHE HAS TO GET STAMPED IF SHE TRAVELS TO INDIA, BUT what if she travels to India, when on OPT status????
Any seniors had experienced the same situation?????????

u can come back on OPT only if you have a valid and current job offer. On F1, u have to come back on stamping.

Hi Simi,
The fact that the company that sponsored your GC shuts down or files for bankruptcy should not have any impact on you. As long as you have an approved I-140, an I-485 pending more than 180 days and a job offer in the same or similar occupation, you are protected by AC-21.
It would be prudent to make sure that you now have copies of all documents relating to your GC case, including complete copy of LC, I-140 petition and supporting docs, H petitions, pay records etc.

I think he has suggested you for Good. And take a look at the add what they have given for LC. If this says you need MBA then you can go for Eb2 else you cannot.
I another case a guy had 10yrs experiece but job requirement asked for 1 yr so they have to go for EB3.

I am currently on H1..working for company A..
Can i work for another company...without transferring my H1 and can i get a 1099 Misc....( they cannot run my payroll as i wont be employed with them)....the work is in the same field...
if 1099 is not feasible.. the only option is to get paid in cash..which i dont want to do..
any inputs.

A great tip from AILA to share with our readers regarding the H1B visa. It seems that H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) for Speech Language Pathologists (SLP) and similar related occupations are being closely monitored to ensure that accurate job duties are being identified to confirm CGFNS (Commission on Graduates of Foreign Nursing Schools) certification requirements.
There are multiple progressive occupations within the Speech Language Pathology career field including, Teachers of Speech and Hearing Handicapped (TSHH), Teachers of Speech and Language Disabilities (TSSLC), Speech Language Pathologist Assistants (SLPA) and Clinical Fellows (CFY), and Speech Language Pathologists (SLP).
While all of these positions require a state license, only SLPs who are certified by the American Speech-Language-Hearing Association (ASHA) may provide direct patient care without supervision, and thus, only certified SLPs require CGFNS certification.

Hi,
My labor got filed in Jun 2008 and went for Audit. I just want to check about, how to calculate 6 years completion. Is it the day I first entered to US on H1b Visa? / the day my H1b get approved? / the day I get stamped.

Has anyone tried extending NJ DL using H1b extension receipt ?
My H1b extension is in VSC and looks like it will take long long time to come back....DL is expiring in 30 days, with EAD my renewal would be for 6 months only as EAD also expires in Aug.
wonder if they will accept H1b receipt with employer letter ?
please share your NJ DL experience.

Last DEC I applied for my H1 for 3 Yaers, and it got approved.

My spouse got her GC in Sep/2000 filed by her parents. Then went back to India to continue studies with 2 yr permission from INS. Return to US after 2 yr and stayed for 8 months in US and then took trip again back to India for 7 months. And then return back in May/2004 and still here since then.
Outline:
Got GC -- Sep/2000
out of US (Nov/2000 - Oct/2002) with permission from INS or USCIS.
Return to US -- Nov/2002
Stayed 10 months in US
Trip to India --- Sep/2003 (for 7 months)
Return to US -- April/2004
Since April / 2004 here in US.
based on this stasts we my spouse apply for citizenship.
USCIS work sheet eligibility says >> 5 yr GC ->> If not out for 30 months in last 5 yr (true) >> No trip out side of US more then 1 yr. (FALSE - If so execpetion -- took permission - true) >> good moral >> etc., >> APPLY FOR CITIZENSHIP.
But when read the eligi. requir. its says absence more then 1 yr cancel all previous contin. of stay ??? confused with this both understanding.....

As far as I know, any person can stay in US legally only on one visa at any point of time. That said, the moment you switched to L1, your H1 is invalid. I'm pretty sure that you can't use your previous H1 extension and you have to file for new H1 petition which starts in April 2008.

Its at the discretion of the officer at POE.......I was asked for my EAD even when I had a valid H1B and last time when I had travelled on AP I was asked for my EAD......
why don't you apply for duplicate documents with the USCIS?

I would like to know if i can file multiple 485s being primary on both ?
Here is my current status ...
1. Company A sponsored my GC and the priority is Oct'03 (never worked for this company)
2. Company B sponsored GC (priority Nov'05). - Currently working for this company
3. Both are EB-3
4. Applied 140 & 485 thru concurrent processing (Company A) in 2004
5. Now that all the dates are current, I am eligible to file 485 (Company B)
So my question is can i have two 485s filed ?
First case is future employment case but has '03 priority
Second case is more strong, but with '05 priority.
I am confused, what to do now.
Any advice is appreciated.

What I'd do is:
Ctrl+click the channel (loads selection)
then go to the layers, and select the layer you want to apply the selection, then press Alt+backspace to fill the selection.
Then ctrl+D to unload selection...
